The man suspected of debauching a preschooler in Little Egg Harbor now also faces a charge of violating Megan's Law by missing his re-registration with local law enforcement.

Elmer Falcon, 44, is one of two men charged with failing to register on schedule. Joseph Randazzo, 60, of Toms River, was also the subject of a complaint filed earlier this week, according to the office of Ocean County Prosecutor Joseph Coronato.

Falcon was arrested November 22 on first- and second-degree sexual-assault counts, and a second-degree charge of endangering the welfare of a child.

County investigators subsequently determined that Falcon hadn't submitted his required annual registry with Little Egg Harbor police. He remains in the Ocean County Jail in Toms River.

Bail on the third-degree registration charge was set at $25,000, separate from his original $200,000 bail, neither with an option for release on payment of 10 percent.

Randazzo was apprehended at his Toms River dwelling and also placed in the Ocean County Jail. His bail was set at $10,000, with no 10-percent option.

Under terms of the state statute, Megan's Law offenders must register with police in their municipalities either once a year or every 90 days, depending on the tiers they occupy.

The maximum penalty for a conviction under the community notification provision is five years in prison and a fine as high as $15,000.
